Who operates this site, on what terms it may be used, and under which law.

In compliance with the disclosure duty set out in article 10 of Spanish Law 34/2002, of 11 July, on information society services and electronic commerce (LSSI-CE), the following details of the owner of this website are hereby stated:

HAKI is a trade name, not a company: any reference to "HAKI" in this document and in the site's other legal texts should be read as a reference to the owner identified above. As a sole trader there is no entry in the Commercial Register, which is optional for this status (article 19 of the Spanish Commercial Code), and the activity is subject neither to mandatory professional-body membership nor to any prior administrative authorisation.

01Purpose of the site and acceptance of these terms

This website is informational: it presents the owner's services, publishes original content — articles and case studies — and lets you write in through a form, subscribe to a newsletter and book a meeting. No products or services are sold online, no payments are processed, and there is therefore no electronic contracting process within the meaning of articles 23 et seq. LSSI-CE.

Anyone who accesses the site, browses it or uses any of its features becomes a user and accepts these terms as published at that moment, together with the Privacy Policy and the Cookie Policy, which form an inseparable part of this notice.

The information published is informative and commercial in nature. It is neither a binding offer nor professional advice of any kind: providing services always requires a quotation or contract accepted in writing between the parties, whose terms prevail over anything stated here.

02Terms of use

The user undertakes to use the site in accordance with the law, good faith and these terms, and to answer for the truthfulness and lawfulness of the information submitted through the forms. In particular, the user shall refrain from:

  • Using the site for unlawful purposes, in a way that harms third-party rights, or that may damage, overload or disrupt its normal operation.
  • Entering false data, impersonating another person, or supplying third-party data without being entitled to do so.
  • Extracting the site's content systematically or automatically — through crawlers, scraping or equivalent techniques — without express authorisation.
  • Circumventing, disabling or tampering with the site's technical security measures, including the anti-spam checks on the forms.
  • Introducing or spreading malicious software or anything else capable of damaging the owner's or third parties' systems.

The site's forms are intended for professionals and businesses and must not be used by anyone under fourteen. The owner may refuse or withdraw access to the site, without prior notice, to anyone in breach of these terms.

03Availability of the site and liability

The owner takes reasonable steps to keep the site available and its content correct and current, but cannot guarantee the absence of interruptions, delays or errors: the service depends on hosting providers and third-party networks, and may be suspended temporarily for maintenance. Nor can the total absence of viruses or other harmful elements be guaranteed, beyond the security measures in place.

The owner is not liable for damages arising from use of the site contrary to these terms, nor for decisions the user takes relying solely on the informational content published here.

Nothing in this notice excludes or limits any liability that cannot be excluded or limited under applicable law, in particular liability towards users who qualify as consumers, or liability arising from wilful misconduct or gross negligence.

05Intellectual and industrial property

The owner holds, or is licensed in, the intellectual and industrial property rights in the site and its constituent elements: text, photographs, illustrations, video, sound, the brand and logo, the colour combination, the layout, the design and the source code. These works are protected by the consolidated text of the Spanish Intellectual Property Act, by applicable European legislation and by the international treaties Spain has entered into.

You may view the content and print, copy or store it for your own personal, private use. Its reproduction, distribution, public communication, transformation or any other form of commercial exploitation without the owner's written authorisation is prohibited, as is removing or altering rights notices or the site's protection systems.

Certain elements belong to their respective owners and are shown under the relevant licence or right of quotation: the trade marks, logos and materials of clients appearing in the case studies, reproduced for identification and portfolio purposes with their knowledge; third-party platform and directory badges; and the typefaces used, under their respective open-source licences. Reproducing any of these requires permission from the relevant rights holder.

If you believe any content on the site infringes your intellectual or industrial property rights, write to INFO@HAKI.MARKETING identifying the content and the right affected; it will be reviewed and, where appropriate, removed as soon as possible.

06Data protection and cookies

The processing of personal data collected through the site — the contact form, the newsletter sign-up and meeting bookings — is set out in the Privacy Policy. The cookies and tracking technologies the site loads, their purpose, their duration and how to block them are set out in the Cookie Policy. Both are reachable from the footer and from the selector at the top of this page.

08Partial invalidity

If any of these terms is declared void or unenforceable by a competent authority, it shall be deemed not to have been included and the remainder shall continue in force, with the affected clause interpreted as closely as the law allows to its original purpose.

09Governing law and jurisdiction

The relationship between the user and the owner is governed by Spanish law.

Where the user qualifies as a consumer, disputes shall be submitted to the courts designated by consumer protection rules, which as a general rule are those of the consumer's domicile. In all other cases, the parties submit to the courts of BARCELONA, expressly waiving any other jurisdiction to which they might be entitled.

Before going to court, any complaint may be addressed to INFO@HAKI.MARKETING and will be dealt with as promptly as possible. Consumers may also turn to the Spanish consumer arbitration system and to the consumer bodies of their autonomous community. The European online dispute resolution platform ceased operating on 20 July 2025, so no referral to it is offered.
